1. Purpose and scope
These terms of use (the “Terms“) govern access to and use of:
- the website tanke.fr (the “Site“);
- TANKE’s internal social media management and scheduling tool, available at smm.tanke.fr (the “Tool“).
The Site and the Tool are together the “Services“. Using the Services means you accept these Terms. If you do not accept them, do not use the Services.
2. Publisher
The Services are published by TANKE, a French SAS with a share capital of EUR 1,000, registered with the Paris Trade and Companies Register under number 805 398 229, registered office 2B rue Eugène Carrière, 75018 Paris, France (“TANKE“, “we“). 3. Access to the Site
The Site is free to access. TANKE aims to keep it available but does not guarantee uninterrupted or error-free access, and may suspend it for maintenance, updates or force majeure. Users must not disrupt the Site, including by introducing malware, mass automated scraping or attempting unauthorised access.
4. Internal tool Tanke SMM (smm.tanke.fr)
4.1 Restricted access. The Tool is for internal use only. It is not offered to the public, sold or made available to third parties. Public sign-up is disabled: only TANKE staff and persons expressly authorised by TANKE (“Authorised Users“) can access it, through a personal account created or approved by TANKE. Access by anyone else is prohibited.
4.2 Purpose. The Tool lets Authorised Users write, schedule, publish and monitor content on TANKE’s own social media accounts and on accounts TANKE manages with their holder’s consent (“Connected Accounts“).
4.3 Obligations. Each Authorised User must:
- keep their credentials confidential;
- use the Tool only for their work for TANKE;
- connect a social media account only with its holder’s authorisation;
- publish only lawful content for which TANKE or the account holder holds the necessary rights, in line with each platform’s rules, including on commercial communication and disclosure of partnerships (French law no. 2023-451 of 9 June 2023 on commercial influence);
- report any lost credentials or suspicious use to TANKE without delay.
TANKE may suspend or remove access at any time, in particular for breach of these Terms or at the end of the working relationship.
5. Third-party platform services
The Tool connects to the platforms below through their official APIs. Accounts are connected through each platform’s authorisation flow (OAuth); TANKE never sees the account password. By connecting an account, the account holder and the Authorised User also accept that platform’s terms.
5.1 YouTube. The Tool uses the YouTube API Services. By using the Tool’s YouTube features, you agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms. Data is handled in accordance with the Google Privacy Policy: https://policies.google.com/privacy. You can revoke the Tool’s access to your account at any time via the Google security settings page: https://myaccount.google.com/permissions.
5.2 TikTok. TikTok Terms of Service: https://www.tiktok.com/legal/terms-of-service. Access can be revoked in the TikTok app (Settings and privacy > Security and permissions > App permissions).
5.3 Instagram (Meta). Instagram Terms of Use: https://help.instagram.com/581066165581870 and Meta Platform Terms: https://developers.facebook.com/terms. Access can be revoked in Instagram (Settings > Website permissions > Apps and websites).
5.4 LinkedIn. LinkedIn User Agreement: https://www.linkedin.com/legal/user-agreement. Access can be revoked in the LinkedIn account settings (Data privacy > Permitted services).
5.5 X. X Terms of Service: https://x.com/tos. Access can be revoked at https://x.com/settings/connected_apps.
TANKE is not responsible for the availability, changes or decisions of these platforms (account suspension, reach limits, API changes).
6. Personal data
Processing of personal data through the Services is described in our privacy policy, in accordance with the GDPR (Regulation (EU) 2016/679) and the French Data Protection Act.
To run the Tool, TANKE stores only the data needed for publishing: technical identifiers and access tokens of Connected Accounts, account name and profile picture, scheduled content and post statistics. This data is used solely to publish and monitor content for TANKE and the accounts it manages. It is not sold, transferred or used for advertising. It is hosted on servers administered by TANKE, hosted by OVHcloud in the European Union, and deleted when the account is disconnected from the Tool or at the account holder’s request.
You have the rights of access, rectification, erasure, restriction, objection and portability: write to hello@tanke.fr. You may also lodge a complaint with the CNIL (www.cnil.fr).
7. Intellectual property
The Site’s elements (texts, images, videos, logos, trademarks, layout) are owned by TANKE or its partners and protected by intellectual property law. Any reproduction without TANKE’s prior written consent is prohibited, except as permitted by law. Content published through the Tool remains the property of its authors or of the Connected Account holders.
8. Liability
TANKE takes reasonable care over the accuracy of the Site but cannot guarantee it is complete or error-free. To the extent permitted by law, TANKE is not liable for indirect damage arising from use of, or inability to access, the Services. Each Authorised User is responsible for the content they publish through the Tool.
9. Links
The Site and the Tool may link to third-party sites. TANKE has no control over them and is not responsible for their content.
10. Changes to these Terms
TANKE may change these Terms at any time. The version in force is the one published on this page with its update date. Authorised Users of the Tool are informed of material changes.
11. Governing law and disputes
These Terms are governed by French law. The parties will seek an amicable solution before any legal action. Failing that, the competent courts of Paris have sole jurisdiction, subject to mandatory jurisdiction rules protecting consumers.
