French influencer law 2026:
Brand contracts & compliance
For influencer campaigns aimed at France, the written-contract threshold is €1,000 excluding VAT under the aggregation rule explained below. It applies from 1 January 2026, not through a new “2026 law”. Disclosure is a separate check. TANKE recommends controlling commitments before content goes live, rather than waiting for invoices.

- Check the whole relevant partnership, not each invoice in isolation.
- Keep contract approval and advertising-disclosure approval separate.
- TANKE recommends one remuneration ledger and a named owner at every handover.
1. What changed in 2026?
The framework starts with France’s Law No. 2023-451 of 9 June 2023, subsequently amended. Decree No. 2025-1137 of 28 November 2025 brought the written-contract threshold into effect on 1 January 2026. “French influencer law 2026” is therefore a useful search term, not the name of a replacement law.
TANKE recommendation: put the applicable legal review date in the campaign brief. Separate current requirements from older explainers, template clauses and platform guidance. When an agency, a local subsidiary and a regional procurement hub all participate, identify which entity is commissioning the work before anyone approves a creator budget.
This guide is for marketing, communications and procurement teams buying campaigns aimed at France. It is not legal advice. Cross-border application depends on establishment, audience, product category and the applicable provisions; obtain campaign-specific advice rather than assuming every foreign creator follows identical rules.
2. Apply the contract trigger correctly
The decree requires a written contract with the Article 8 particulars at €1,000 or more excluding VAT. Combine remuneration and benefits in kind granted by the same advertiser to the same influencer during the same year for services pursuing the same promotional objective. Equality counts. The test is not “more than €1,000 per post”.
TANKE recommendation: review the expected commitment before commissioning, then review additions before agreeing them. Do not use separate purchase orders as a substitute for analysing the actual arrangement. Ask legal and finance to document ambiguous grouping or valuation questions; an operational spreadsheet cannot settle them.
Keep a separate budget line for usage rights, paid amplification and additional production. These lines make commercial negotiations clearer, but their labels alone do not determine the legal treatment. A scope change should return to the approver instead of remaining an informal message between a creator and a community manager.
3. Classify gifts before booking them
The Ministry of Economy’s guidance, “Suis-je influenceur ? Quelles démarches ?”, distinguishes a product supplied for requested promotional content from an unsolicited modest product or optional event invitation with no request to publish. The first is commercial influence; the latter examples are described as probably outside that activity, with transparency still recommended.
TANKE recommendation: record the actual exchange, not just the label “PR gift”. Save the outreach message, any promised deliverable and the creator’s acceptance. If someone later requests a post, reopen the classification instead of relying on the original no-obligation description.
Agree who proposes the product valuation, who reviews it and where supporting evidence is stored. Do not quietly assign a zero value because no cash changes hands. Equally, do not turn every unsolicited parcel into a contracted campaign without examining the facts. Keep the legal classification and any separate tax question with the appropriate advisers.
4. What a French influencer contract must include
Article 8 of Law No. 2023-451, in its version effective since 11 June 2023, specifies five areas: parties’ identities, postal/electronic contact details and tax residence; missions; remuneration or calculation method and benefits-in-kind value/award terms; rights and obligations, including intellectual property; and French governing law where the statutory France-targeting condition applies.
The article provides for nullity for non-compliance, not an automatic criminal fine for a missing agreement. Article 8 III also provides joint civil liability for damage to third parties arising from contract performance; this is not automatic shared criminal guilt.
TANKE recommendation: translate the creative brief into deliverables that a reviewer can actually check: format, platform, deadlines, revision process and evidence delivery. Specify the proposed usage territory, duration, placements and paid-media permissions instead of treating “content ownership” as a complete rights brief. For brand-safety clauses, approvals and crisis prevention, see our guide to protecting your brand in influencer campaigns.
Give one person responsibility for reconciling the agreement, purchase order and creator brief. If they conflict, resolve the discrepancy before approval. Store the accepted version beside the campaign record, not in an individual team member’s inbox. A reusable influencer contract template is a starting point; it is not evidence that a particular activation has been reviewed.
5. Check the published advertisement separately
The Ministry of Economy’s “Influenceurs : quels sont mes devoirs ?” guidance, read on 27 October 2026, requires a clear commercial identification and identification of the brand: “Publicité”, “Collaboration commerciale” or equivalently clear wording. Do not confuse this with the contract threshold. Specific disclosures concern retouched appearance and AI-generated faces or silhouettes, not every use of AI.
Publicly funded training promotions have additional rules under Decree No. 2026-233, applicable from 2 April 2026, and the order of 26 May 2026. Sector review matters; a generic creator template is not enough.
TANKE recommendation: approve disclosure instructions for the actual format, then capture what the audience receives. Review a story as a story, a video as a video and a livestream plan as a live format. A clause in the agreement does not demonstrate that the final post is correctly presented.
Keep a correction contact and escalation route available during launch. If the format, claim or product changes, return the content to review. Avoid attaching a single sensational penalty figure to every compliance problem: the relevant breach and legal basis must be identified separately.
6. Build a remuneration ledger
TANKE operational recommendation, not a statutory filing format: use one campaign-control record to connect finance, procurement and content approval. The objective is to make an additional commitment visible before it becomes an unreviewed promise. A spreadsheet can work if ownership and access are clear.
| Record | Control question |
|---|---|
| Advertiser, influencer, year, objective | Is this the right grouping for the partnership? |
| Cash and benefits, separately | What has been committed, and what supports the valuation? |
| Contract version and approver | Does the accepted agreement match the current brief? |
| Changes and publication evidence | Was the revised scope reviewed and the live output captured? |
Give the objective a plain-language description and an internal identifier. Link the underlying documents rather than duplicating personal information across multiple trackers. Finance should be able to reconcile commitments with invoices; marketing should be able to find the approved deliverables without asking procurement to reconstruct the campaign.
Set an early internal alert rather than waiting for an invoice to reveal a problem. Treat it as a review prompt, not a legal conclusion. Keep disputed amounts visible until resolved, and record who approved the resolution. This approach is a recommended governance design, not a claim about proprietary software or measured client results.
7. Assign owners before launch
TANKE’s recommended stage checklist: name an owner and a handover artifact, not just a shared “compliance” responsibility. A small activation can use the same sequence with fewer people; the important point is that decisions do not disappear between teams.
- Brief / marketing: record audience, product category, objective and proposed formats.
- Commitment / procurement: confirm counterparties, remuneration record and the agreement route.
- Review / legal: resolve applicable-law, sector, rights and disclosure questions.
- Launch / campaign lead: compare the approved brief with scheduled content and capture publication evidence.
- Change or close / finance and campaign lead: reconcile additions, corrections, actual payments and rights-expiry dates.
For changes, use a short written delta: what changed, what it costs, what permissions it needs and who accepted it. Pause the affected deliverable when an unresolved issue would make the original approval unreliable. Do not require the whole programme to stop if the issue can be isolated safely and reviewed.
The buying criterion is therefore practical: can the proposed team explain its handovers and produce the decision record? Ask this when selecting an influencer marketing agency, alongside creative approach and budget. It is more useful than a general assurance that everything is “compliant”.
